Kootenai County officials announced Monday that boat launch facilities at Bayview, Spirit Lake, and Lower Twin Lakes will remain open to the public, despite a breakdown in lease negotiations with the Lakes Highway District. The dispute centers on a proposed five-year agreement that expired on Sept. 1 without a resolution.
The Kootenai County Board of Commissioners stated it would leave management of the docks and facilities to the Lakes Highway District while keeping them operational. However, the district has refused to commit funds, employees, or equipment until legal questions regarding the use of highway district money are resolved.
Disagreement Over Financial Obligations
The Lakes Highway District argued that the proposed lease required assuming substantial additional obligations not previously borne by the agency. These responsibilities included construction costs, ongoing maintenance, fee enforcement within district rights-of-way, liability releases, and property conveyance provisions.
While Kootenai County paid for the conceptual site plan and the preparation of the lease agreement, the Lakes Highway District maintained that funding a planning document did not equate to paying for physical improvements. The district also cited unresolved questions about the legal authority to use its funds for these specific purposes.
Negotiations Stall on Legal Concerns
Lakes Highway District Commissioner Rod Twete emphasized that the agency did not walk away from negotiations but rather sought clarity on legal and financial terms. The district submitted revisions that retained the five-year term, included all three launch properties, and preserved county authority to operate and collect fees.
The proposed changes also kept nearly all county terms intact, with limited modifications requested only regarding construction language at the Bayview site. Despite these concessions, the Lakes Highway District stated it could not proceed without determining whether the expenditures were legally authorized.
“The public deserves the complete context,” Twete said. “This was not simply a choice between accepting county management and closing public boat launches.”
County Response Pending
Kootenai County sent a letter on Sept. 2 stating that docks would remain in place for district management. The Lakes Highway District noted that the letter did not address its revisions, legal concerns, cost obligations, or other outstanding issues.
The Lakes Highway District previously offered to transfer the launch properties to the county without compensation as an alternative solution. As of late Thursday, the Kootenai County Board of Commissioners had not responded for comment regarding the ongoing standoff or future steps for resolving the lease impasse.
